Artificial intelligence, particularly its generative variant, is rapidly transitioning from a futuristic concept to a present-day disruptor across industries. While it feels like welcome progress when „the algorithm” develops a knack for predicting our next binge-streaming obsession or predicts what we might next like most to type (especially with this writer’s large thumbs), a distinct shift occurs when it starts to emulate creativity we think of as uniquely human – crafting poetry, writing a story, conversing emotively, penning a song or generating realistic paintings, photographs or videos. It is at this juncture that unease can crystallize into tangible controversy, demanding a closer look at the underlying dynamics and, critically, the emerging legal frameworks surrounding AI technologies.

The video game industry, a digital native with decades of experience integrating AI, offers a compelling microcosm for understanding this evolution. Whether or not it’s been explicitly recognized as „AI”, the integration of AI-like algorithms into video games and games development is nearly as old as the medium itself: one of the earliest games, Christopher Strachey’s 1951 checkers game, was later that decade refined by Arthur Samuel to learn from gameplay to improve computer-controlled outcomes. Since then, games have continuously iterated on AI technologies, often behind the scenes. Yet, even this tech-forward sector now grapples with its own AI-related disputes. This prompts essential questions: What transforms an algorithm into „artificial intelligence” in the public and legal imagination? And at what point does its application become contentious, particularly from legal and ethical standpoints?

The answer lies not in a binary switch from „simple algorithm” to „intelligent AI,” but along a spectrum. AI generally refers to computer systems performing tasks typically associated with human intelligence – learning, reasoning, problem-solving, decision-making – often with a degree of autonomy even in unpredictable environments. Gameplay, inherently dynamic in nature, means many games technologies fit this description. Consequently, AI-related controversy is rarely about the technology in isolation.

While these dynamics are not exclusive to the games industry, its high public visibility and inherently creative nature often thrust its AI-related technological and ethical considerations into the spotlight, typically igniting at the intersection of three key factors: the technology’s sophistication, its visibility to the public or other stakeholders, and the perceived displacement or exploitation of human (especially creative) roles. Fueling these controversies are the vast datasets, often encompassing human-created content harvested from a globally-connected internet, that power these newer AI engines, stoking legal and ethical fires.

From Accepted Procedure to Generative Disruption and Controversy

The aspiration, for many, is a future where generative AI becomes an accepted, empowering tool for games creators in new ways, much like established digital creation suites for image editing, digital art, or 3D animation have become. And indeed, for decades, the games industry has often successfully integrated AI, in ways that are foundational yet usually invisible, augmenting human creativity rather than overtly replacing it. Clearly, there is a need for some computer-assisted content creation in the digital medium of games, because not every pixel, byte, line, or gameplay move can be human-created.

For example, procedural generation is a technique used and refined by developers to create vast amounts of game content. Examples range from randomized dungeon or level layouts (called Rogue-likes based on the 1980s game of the same name) such as in Supergiant’s Hades games or in the Ghost Ship Games indie hit Deep Rock Galactic, to the generation of terrain in Microsoft’s Minecraft or 2K Games’ Civilization series (which use random, algorithm generation to ensure every landscape is unique). Procedural generation is seen as augmenting human creativity, enhancing replayability, and achieving a scale impractical for manual creation, particularly for large or tedious tasks – indeed, no labor force could feasibly generate the over 18-quintillion planets in Hello Games’ No Man’s Sky, nor would anyone reasonably finance such an endeavor. These systems are often invisible to the end-user (even as their sophistication has grown over time), or in the very least their outputs are clearly framed as system-generated variations within a human-designed structure. Controversy is minimal because the AI is seen as an enabler, not a usurper of core creative functions.

Similarly, we can look to examples of players’ interactions with their game worlds. No one bats an eye at computer-controlled ghosts patrolling a maze in Bandai Namco’s Pac Man (undoubtedly reacting to player movements, albeit simplistically), scripted character encounters in Larian Studios’ Baldur’s Gate 3 (written meticulously by human beings, but there was undoubtedly at least one automated grammar check?), or graphic artists using complex computer imaging tools to press one button to apply a complex, shadowed paint texture to a scene (which would have previously taken hours to paint).

The craft of programming itself, another cornerstone of game development, has also long benefited from AI-like assistance, often operating behind the scenes. Automated and AI-assisted coding tools, trained on vast repositories of code, help developers solve complex problems, accelerate bug-fixes, and refine software quality. While software engineering demands logical precision to produce predictable outcomes, it is also an intensely creative discipline, where elegance in code can be as artful to its creator as a brushstroke is to a painter. Yet, this form of creativity – manifested in intricate algorithms or efficient system architectures – typically doesn’t evoke the same immediate public connection or emotional response as a visual artwork or a piece of music. Consequently, the integration of AI as a tool for programmers, while transformative within the field, has largely evolved without the broad public alarm that arises when AI ventures into more visibly „human” artistic domains.

The Tipping Point: When Sophistication, Visibility, and Displacement Converge

Public controversy emerges when AI systems become sophisticated enough to produce outputs traditionally associated with human creativity, especially when these systems become highly visible and raise questions about the impact on human labor and skills.

We see this repeat across various domains within gaming. Publishers who use AI tools for promotional materials have encountered varied reactions, including concerns from artists and online communities about the implications of these AI tools for the future of illustrators and graphic designers. Voice actors have engaged in negotiations regarding the use of their performances in training AI voice models, illustrating the evolving nature of rights and licensing in this area (and in one case, resulting in a landmark agreement between SAG-AFTRA and an AI tech company allowing guild members to license their voices for AI applications under specific conditions). Digital storefronts increasingly require developers to disclose the use of generative AI in creating game assets, a nod to the growing demand for transparency and the potential impact on consumer perception and creator attribution. We have even seen recent examples of AI-controlled characters and chatbots being made to say and do offensive things because anonymous players on the internet will just do that (a sad reality that designing a generative AI tool to be safe necessarily includes anticipating and mitigating how malicious users might attempt to provoke unintended or harmful outputs).

Consider Ubisoft’s „Ghostwriter,” an internal AI tool designed to generate first drafts of „barks” – short, ambient lines of dialogue for non-playable characters, a staple of „open world games” to make the world react to the player’s progress. While Ubisoft emphasized its collaboration with human writers in developing the tool, and that the tool would only provide a draft of these ambient lines for review, editing, and selection in order to reduce the manual workload (thus allowing writers to focus on core narrative content instead of tedious bark-writing), the „Ghostwriter” tool sparked a range of responses at a Game Developers Conference lecture. Feedback regarding the tool ranged from practical (concerns that editing AI-generated dialogue could waste time), to benevolent (potential reduction in entry-level job opportunities for junior writers), to dystopian (fears of corporate prioritization of automation – and the associated drive for efficiency and cost reduction – over human talent). All of this over a tool that, quite frankly, takes a very tedious job and makes it more efficient, which is more or less a cornerstone of good business.

The Law Steps In – The Slow Regulatory Response to the Break-Neck Speed of Technology

The intense debates and ethical questions sparked by tools like Ghostwriter are not isolated incidents; they signal the broader societal impacts that are now prompting a global legal response. Indeed, the rapid proliferation of AI has spurred a global flurry of regulatory activity.

In fact, the OECD Policy Observatory is currently tracking more than 1000 policy initiatives across 80+ countries. We have seen everything from comprehensive AI legislation like the EU AI Act, under which the „Prohibited Practices” ban took effect on February 2, 2025, to standards emerging such as the Institute of Electrical and Electronics Engineers „Standard for Algorithmic Bias Considerations” to US Executive Orders directing „free markets, world-class research institutions, and entrepreneurial spirit” in AI innovation.

As law slowly adapts to the breakneck speed of technological advancement, businesses deploying AI must grapple with fundamental legal questions being addressed by regulators around the globe:

  • How can we ensure AI systems are developed and deployed safely, fairly, equitably, and transparently?
  • What frameworks are needed for robust risk management, and what level of liability attaches when AI systems err or cause harm?
  • Who should oversee AI systems, and what mechanisms should exist for redress and complaint resolution?
  • What specific AI applications or practices should be deemed unacceptable or prohibited?
  • How can intellectual property in training data be respected, and what are the implications of using copyrighted material without license?
  • Who owns the output generated by AI systems, and how does this affect existing IP laws?
  • How can trade secrets and confidential business information be protected when using third-party AI tools or incorporating AI into proprietary systems?
  • What are the legal and ethical responsibilities concerning AI-driven job displacement and the future of labor?
  • How can algorithmic bias be identified and mitigated to prevent discriminatory outcomes?
  • How should legal frameworks protect an individual’s personality, likeness, and voice from unauthorized AI replication or deepfakes?
  • How can individual data privacy be safeguarded within AI systems, ensuring meaningful consent and control over personal information?

The gaming industry’s journey with AI, from simple rule-based opponents to sophisticated generative systems, illuminates universal patterns and pre-empts the broader societal and legal reckonings that every sector will face. The anxieties and legal questions sparked by AI-generated game art, automated script lines, or synthetic voices now echo far beyond gaming, into creative industries, software development, and customer service. Understanding how the games sector has confronted – and continues to confront – these challenges offers invaluable lessons. In light of these experiences, and with a legal landscape still solidifying, a proactive and principled approach to AI adoption is paramount. The goal is not to stifle innovation, but to integrate AI effectively, ethically, and legally. To that end, companies across all sectors should consider the following:

  1. Regularly evaluate the evolving technological capabilities of AI systems and shifts in societal norms and legal regulations, as what was acceptable yesterday may be contentious tomorrow. Ensure organizational alignment with the company’s AI strategy, fostering ongoing engagement with technological and regulatory developments across all teams.
  2. Invest in research and techniques to identify, understand, and mitigate biases in AI algorithms, training data, and outputs to ensure fairness and prevent unintended discriminatory impacts.
  3. Develop clear internal policies regarding the use of AI, emphasizing proactive transparency where appropriate (e.g., disclosing AI-generated content to users and explaining its purpose) and establishing robust accountability frameworks for AI system performance and outcomes.
  4. Implement comprehensive ethical guidelines for AI development and deployment, ensuring strict compliance with existing and emerging laws. This includes revisiting IP strategies, updating contractual frameworks with employees and vendors to address AI-specific issues (like consent for training data use and IP ownership of AI outputs), and conducting thorough risk assessments.
  5. Engage in open dialogue with community members, employees, and other stakeholders to build trust, gather diverse perspectives, and collaboratively shape the appropriate and ethical uses of AI technology within your specific context.

None of these challenges are entirely unique to AI; they echo historical adaptations to transformative technologies. The key is to recognize that the line where AI deployment shifts from beneficial tool to risky proposition is dynamic, influenced by technological advancement, public perception, and legal evolution.

The games industry, often a vanguard of technological adoption, has inadvertently become a seasoned veteran of the complex socio-legal battles carved out by advanced AI. Its journey, marked by both enthusiastic but sometimes divisive adoption and sometimes alarmist apprehension (within studios, and by external stakeholders), underscores a critical lesson: AI controversy is not inherent to the technology itself but emerges dynamically at the confluence of its sophistication, its visibility, and its potential to displace or devalue human endeavor.
