BIMCO Publishes USTR Clause for Time Charter Parties 2025 | NorthStandard

BIMCO has published the USTR Clause for Time Charter Parties 2025, developed in response to the U.S. Trade Representative’s recent actions targeting PRC-owned and operated vessels calling at U.S. ports, stating:

This clause addresses fees incurred under Annexes I and II of the USTR Notice, specifically for vessels with a nexus to the People’s Republic of China in a time charter context. This clause may be incorporated into new charterparties and into existing charterparties.

The clause is intended to assist owners and time charterers with the commercial and operational implications of the recent USTR actions against PRC built, owned and operated vessels, with a clear contractual allocation of risk and responsibility for service charges.

NorthStandard were involved in the drafting process as a member of the BIMCO sub-committee, working alongside BIMCO and other leading industry participants.
